eCASA VITTORIA LIMITED ("eCasa") - Terms and Conditions

1. I, the undersigned hereby agree to the following terms and conditions in exchange for the access and use of the services offered by eCasa Vittoria Limited ("eCasa"), specifically online retail of variety of products and on-going promotion of new products for purchase, together with delivery of goods bought on-line (the "Services"):
1. I agree and acknowledge that eCasa is not the manufacturer of the products provided to me online, and accordingly, I agree that eCasa is not nor will be, responsible for any defects in the products that I receive from eCasa.
2. I, understand that subject to the provisions herein dealing with defective items, I may return a product that is not damaged or defected within [twenty-one (21) days] of receipt thereof for a full refund in the event that there is no defect with the product. Please note that all items discounted at 30% or more are final sale.
3. I agree to comply with and acknowledge reading the policies of eCasa.
4. I understand that eCasa will from time-to-time, engage third parties to assist with the provision of services, and that eCasa is not responsible for any act or omission causing damage or injury. eCasa will use reasonable best efforts to ensure a commercially reasonable standard of performance via its contractual arrangements.
5. I consent to the use, disclosure and collection of the personal information for the purposes of providing the Services, directly or indirectly.
6. I agree that I shall owe payment to eCasa at the time I make my purchase order, and I shall be responsible for any charges, costs, including legals or penalties associated with non-payment, and a rate of ten percent (10%) per annum compounded shall apply for all amounts overdue, including accrued interest which shall form part of the debt.
7. eCasa takes reasonable steps to accurately describe the products available on its website, but this is subject to errors and omissions.
8. I agree and understand that orders are processed and shipped on Business Days only. Orders received by 1:00p.m Eastern time are normally processed on the same Business Day, and orders received after that are normally processed on the next Business Day, if the same is not a statutory holiday. Business Day, for the purposes of this arrangement, shall mean any day other than the Saturday, Sunday or statutory holiday in the State of Michigan. Payment must be made via one of the following four (4) major credit cards, VISA, MasterCard, American Express or Discover and should be done via PayPal subject to the terms of the PayPal arrangement. I understand that eCasa is not responsible for Paypal's collection, use or disclosure of my information. eCasa is merely the recipient of information regarding payment from me.
9. Sales tax at a rate of six percent (6%) will apply to all orders shipped within the State of Michigan.
10. Orders cannot be modified or cancelled once they have been placed.
11. Shipping may occur for ground service delivery, next business day delivery, or in two (2) business day delivery, but is always subject to receipt of payment. I agree that I shall report all damaged or defective items within 48-hours of receipt in order to receive a full refund. And this will be reported via email to info@ecasavittoria.com and will be deemed to be received upon deliver to eCasa, which can be proven by eCasa's servers information or by evidence of a read receipt or acknowledgement from eCasa In order to return your order, I will undertake the following steps:

1. Pack the original product received in its original box, and include the original packing slip therewith; and

2. Ship the package back to eCasa by any carrier company that I so choose at my own risk upon receipt of the returned item, eCasa will process my refund.

12. I understand that eCasa does not provide exchanges.
13. eCasa is a licensed distributor of all the brands advertised by it online and thereby ensures authenticity of the product as promoted by the brand designer. I do understand that the brand designer may use other third parties in the production of their designer brand merchandise.
14. I understand that I will take title to the property upon delivery of same by eCasa.
15. eCasa shall not be held liable for damages or costs resulting from any breach, failure to perform or negligence of any terms or our agreement or applicable laws by any third party service provider involved in the delivery of the services.
16. This agreement shall be governed by the laws of the Province of Ontario and I hereby agree to attorn to the exclusive jurisdiction of the Province of Ontario and the laws applicable therein.

2. In the event that I fail to render payment for the goods I receive from eCasa, evidence of delivery of which via third party shall be deemed to be sufficient, I shall indemnify and hold harmless eCasa for any and all losses, costs, damages, claims, liability associated with either obtaining payment for the products delivered or obtaining the product back in a condition that is acceptable to eCasa.

3. I am of a legal age to make a contract in the jurisdiction where I live.
4. I am the credit cardholder of the card that is being used to complete the payment for eCasa's services.
5. I understand that by using the Services, I am deemed to be in agreement with the aforementioned terms.
